This is true, but in this case Cinemark policy on carry had nothing to do with it. The entire city of Aurora CO. is a "gun Free Zone". It is against the law to carry anywhere in the city and anyone using a firearm to stop this massacre would have been arrested.

About 100 moviegoers in Edgewater were evacuated from a showing of "The Dark Knight Rises" tonight after a patron saw someone opening an emergency exit, officials said.
When police couldn’t find the person believed to have opened the door, the theater was evacuated, a police spokesman said.

That is not true. You can carry concealed with a permit or open without a permit. I lived there for most of my life.

I know that your heart is in the right place here and on a complimentary side of the issue at least for this crowd, but making statements like the above DOESN'T Help. STOP HELPING.

I can't find the link right now, but he was apparently trying to join a local gun club; he was almost accepted, but when he called to setup his orientation class, he freaked out the staff who were then told to not let him in if he showed up at the class.

That is not true. You can carry concealed with a permit or open without a permit. I lived there for most of my life.


This ordinance banning the carrying of "dangerous weapons" was deemed "unenforceable" when Colorado state prohibited cities and counties from enforcing such laws in 2003. After talking to officials the Aurora Police Department, we found that counties can now issue concealed-and-carry permits, BUT in Aurora, it is still against the law to fire the weapon unless at a shooting range (or if you are an officer on duty). Therefore, it would have been illegal for anyone to fire in the theater. Also, the theater reportedly had a ban on any and all weapons. Anyone without a conceal-and-carry permit in Aurora must also keep their guns unloaded unless at a range.

** See Aurora Code Sech ttp://library.municode.com/index.aspx?clientId=10331 It shall be unlawful for any person to fire, shoot, or discharge any firearm; crossbow; bow and arrow; slingshot; blowgun; BB gun or pellet gun, whether powered with gunpowder, compressed air, or gas cartridges; gas gun; or any weapon whatsoever within the city limits. The way I read it, "No gun" signs in Colorado do not have the force of law. Like Minnesota, a "No guns" sign does not constitute warning for purposes of trespass violation, so I perceive no legal penalty for a permit holder ignoring such a sign at the theatre. Additionally, AFAIK from reading the statutes, Colorado state law pre-empts the firearms laws of local governments (just like Minnesota), so technically Aurora's restrictions are legally irrelevant.

Probably predictable, but tends to belie a lot of the rhetoric about the public favoring more gun control.

Washington (CNN) -- In the aftermath of last week's deadly Colorado movie theater shooting, background checks for those wanting to purchase guns in the state spiked more than 40%, authorities said Tuesday.
Data supplied by by the Colorado Bureau of Investigation shows that from Friday through Sunday, a total of 2,887 people were approved to buy firearms. That's a 43% increase over the previous Friday through Sunday, when 2,012 background checks cleared.
On the Friday and Saturday right after the shooting, more than 1,200 applicants were approved on each of those two days. Figures from earlier in the month showed a low of 820 and a high of 929 approvals on Fridays and Saturdays through the state's InstaCheck unit.

Minneapolis Code:
Firearms and fireworks.

No person shall fire or discharge any cannon, fowling piece, pistol, revolver or firearm of any description, or fire, explode or set off any squib, cracker or other thing containing powder, or other combustible or explosive material, within the limits of any park or parkway; excepting exhibitions of fireworks given under the direction or by permission of the park and recreation board or its proper officers. (Code 1960, As Amend., § 1010.371)


ETA: There have been numerous cases of a permit holders and homeowners using firearms in self defense and not being charged in Aurora.

s a uneneforceable code when it comes to self-defense (State law trumping city code)?
